Jasper Uptime (“Jasper Uptime,” “we,” “us,” or “our”) provides uptime for critical systems in remote and challenging environments. This Privacy Policy explains how we collect, use, disclose, and protect personal information through our website at jasperuptime.com (the “Site”) and through our marketing and sales activities.

We do not sell your personal information. We have not sold personal information in the preceding twelve months, and we do not sell personal information to any third party for money or other valuable consideration. We also do not share your personal information for cross-context behavioral advertising as that term is defined under California law.

This policy does not cover personal information we process while delivering services under a customer contract. That information is governed by the applicable service agreement between Jasper Uptime and the customer.

2. Information we collect

2.1 Information you give us directly

When you submit a form, request a document, register for a webinar, or book a meeting with us, we collect:

  • Name (last name)
  • Company name
  • Email address
  • Phone number (optional)
  • Any additional information you choose to include in a message, booking, or webinar registration

We also collect the contents of email, phone, and other correspondence you send us.

2.2 Information collected automatically

When you visit the Site, we and our analytics and advertising providers may collect:

  • IP address, and approximate location derived from it
  • Browser type, device type, operating system, and screen characteristics
  • Pages viewed, time on page, links clicked, and referring URL
  • Date and time of visit
  • Advertising click identifiers — for example, a Google Ads click ID appended to a link that brought you to the Site
  • Cookie and similar identifiers — see Section 6

Analytics and advertising cookies are set only after you consent through our cookie banner. Strictly necessary cookies are set regardless, because the Site cannot function without them.

2.3 What we do not collect

We do not collect Social Security numbers, government identification numbers, financial account numbers, precise geolocation, biometric data, or health information through the Site. We do not collect sensitive personal information as defined under California law, and we do not use or disclose sensitive personal information for any purpose that would require us to offer a “Limit the Use of My Sensitive Personal Information” option.

We do not knowingly collect personal information from anyone under 18. See Section 11.

3. How we use your information

We use personal information to:

  • Respond to your inquiry, quote request, or booking
  • Send you the document, resource, or webinar access you requested
  • Deliver marketing communications you have consented to receive
  • Qualify and manage sales opportunities in our customer relationship management system
  • Understand how the Site is used, and improve its content and performance
  • Measure the effectiveness of our advertising
  • Detect and prevent fraud, spam, and abuse of our forms
  • Comply with legal obligations and enforce our agreements

Legal basis and consent (Canada)

For individuals in Canada, we rely on your express consent for commercial electronic messages and for non-essential cookies, and on implied consent or a legitimate business purpose when responding to an inquiry you initiated. You may withdraw consent at any time — see Section 8 and Section 9.

4. When we disclose information

We disclose personal information only in the circumstances below. None of these is a sale.

4.1 Service providers

We use third-party providers to operate the Site and our marketing. They may process personal information only on our instructions and only to provide services to us. They are contractually prohibited from using it for their own purposes.

4.2 Legal and protective disclosures

We may disclose personal information when we believe in good faith that it is necessary to comply with law, a subpoena, or a court order; to enforce our terms; or to protect the rights, property, or safety of Jasper Uptime, our customers, or the public.

4.3 Business transfers

If Jasper Uptime is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction. We will notify you and, where required, obtain consent before your information becomes subject to a materially different privacy policy.

5. We do not sell your personal information

We want to be unambiguous about this:

  • We do not sell personal information. We do not exchange personal information for money or other valuable consideration with any third party.
  • We do not share personal information for cross-context behavioral advertising. We do not disclose your personal information to third parties so that they can target advertising to you across other businesses’ websites or apps.
  • We do not sell or share the personal information of anyone under 16.
  • We do not disclose personal information to data brokers or list vendors.

Because we do not sell or share personal information, we do not offer a “Do Not Sell or Share My Personal Information” link. If this ever changes, we will update this policy and provide the required opt-out mechanism before any such activity begins.

6. Cookies and your consent choices

The Site uses cookies and similar technologies. We use Cookiebot to obtain and record your consent, and Google Consent Mode so that our analytics and advertising tags respect your choice.

We group cookies into four categories:

Until you consent, non-necessary cookies are blocked and our tags run in a restricted mode that does not store identifiers on your device.

Changing or withdrawing your consent

You can change or withdraw your consent at any time. Withdrawing consent does not affect processing carried out before you withdrew it.

You can also block or delete cookies through your browser settings. Blocking necessary cookies may prevent parts of the Site from working.

Global Privacy Control

We honor the Global Privacy Control (GPC) signal. If your browser or extension sends a GPC signal, we treat it as a valid request to opt out of any sale or sharing of personal information, and we apply it to that browser.

Do Not Track

Browser “Do Not Track” signals are not standardized, and the Site does not respond to them. We honor GPC instead, as described above.

Cookie declaration

For the current, itemized list of cookies in use on the Site — including each cookie’s name, provider, purpose, and expiry — open the cookie settings panel using the button above. The panel is maintained automatically and always reflects what is actually running on the Site.

7. Third-party analytics and advertising, in plain terms

Google Analytics 4 places cookies that let us see how visitors move through the Site. We have IP anonymization in effect, and we do not send Google any information that directly identifies you. Google’s practices are described at policies.google.com/privacy. You may install Google’s opt-out browser add-on at tools.google.com/dlpage/gaoptout.

Google Ads lets us measure which advertisements lead to inquiries. You can manage the advertising Google shows you at myadcenter.google.com.

Zoho hosts our forms and scheduling, and delivers our marketing email. Zoho’s privacy policy is at zoho.com/privacy.html.

8. Email and text message communications

Email

Marketing email. We send marketing email, such as newsletters, webinar invitations, and promotional campaigns, to two groups of people.

People who have given us express consent, for example by submitting a form, registering for a webinar, or otherwise affirmatively asking to hear from us.

Business contacts of Jasper Uptime, meaning a named person at a company where there is an existing or prior business relationship: we have done business with that company, met at an industry event, been introduced, or exchanged business contact information. We send this category only to recipients in the United States, only to a business address, and only about products and services relevant to that person’s work.

You can opt out of all marketing email at any time using the unsubscribe link in any message. We honor that request immediately and permanently, and we apply it to every list we hold.

Individual business correspondence. We may also write directly to a named person at a business, about that business, where we have a genuine business reason to make contact. These are individual messages written and sent by a person, not bulk or automated campaigns. Each one identifies us clearly, gives a valid physical mailing address, and tells you how to ask us not to write again. We honor that request immediately and permanently. We send this kind of correspondence only to recipients in the United States.

We do not send marketing email to consumers, only to people in a business capacity.

Every commercial email we send includes:

  • Our identity and a valid physical mailing address
  • A way to opt out, honored promptly

Unsubscribe requests are honored promptly, and in no case later than 10 business days, as required under Canada’s Anti-Spam Legislation (CASL). You may also unsubscribe by emailing our privacy contact.

Transactional and relationship messages — such as replying to your inquiry, confirming a booking, or delivering a document you requested — may still be sent after you unsubscribe from marketing.

Text messages (SMS)

If you provide a mobile number and expressly opt in, we may send you text messages related to your inquiry or booking. We will not send you marketing text messages without your express prior consent, and consent to receive text messages is never a condition of purchasing anything from us.

  • Message frequency varies.
  • Message and data rates may apply.
  • Reply STOP to any message to opt out, or HELP for assistance.
  • We do not share mobile information with any third party for marketing or promotional purposes. Mobile information is shared only with providers that help us deliver the messages, and they may not use it for their own purposes.

9. Your privacy rights

9.1 Everyone

Regardless of where you live, you may contact us at our privacy contact address to request access to, correction of, or deletion of your personal information, or to unsubscribe from our communications. We will do our best to honor any reasonable request.

9.2 California residents (CCPA/CPRA)

You have the right to:

  • Know what personal information we have collected about you, the sources, the purposes, and the categories of third parties to whom it is disclosed
  • Access a copy of the specific pieces of personal information we hold
  • Delete personal information we have collected, subject to exceptions
  • Correct inaccurate personal information
  • Opt out of sale or sharing — as stated in Section 5, we do neither
  • Limit the use of sensitive personal information — we collect none
  • Non-discrimination — we will not deny you services, charge you a different price, or provide a different level of quality because you exercised a privacy right

9.3 Texas residents (TDPSA)

If you are a Texas resident, you have the right to confirm whether we process your personal data, access it, correct it, delete it, obtain a portable copy, and opt out of targeted advertising, sale, or profiling that produces legal effects. If we decline your request, you may appeal that decision by replying to our response. If the appeal is denied, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov.

9.4 Other U.S. states

Residents of other states with comprehensive privacy laws — including Colorado, Connecticut, Virginia, Utah, Oregon, and Montana — have substantially similar rights. We extend the rights described above to all U.S. residents regardless of state.

9.5 Canadian residents (PIPEDA)

If you are in Canada, you have the right to:

  • Access the personal information we hold about you, and be told how it has been used and to whom it has been disclosed
  • Correct inaccurate or incomplete information
  • Withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice
  • Challenge our compliance with Canadian privacy law

Direct any challenge to our privacy officer first. If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada at priv.gc.ca or 1-800-282-1376.

9.6 How to exercise your rights

Email our privacy contact with your request and enough information for us to locate your records — typically the email address or phone number you gave us.

  • We will verify your identity before acting on an access, deletion, or correction request. Verification usually means confirming that you control the email address or phone number in our records. We will not use verification information for any other purpose.
  • We will respond within 45 days for U.S. requests and within 30 days for Canadian requests. If we need more time, we will tell you why and when to expect a response — up to an additional 45 days where the law allows.
  • Requests are free, unless they are manifestly unfounded or excessive, in which case we may charge a reasonable fee or decline, and will explain why.
  • An authorized agent may submit a request on your behalf with written proof of authorization. We may still contact you directly to confirm.

10. How long we keep information

We keep information longer where the law requires it, or where it is needed to establish, exercise, or defend a legal claim.

11. Children

The Site is a business-to-business site directed at commercial and industrial operators. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us personal information, contact our privacy contact and we will delete it.

12. Where your information is processed

Jasper Uptime is based in the United States, and our service providers process and store personal information in the United States.

If you are located in Canada or elsewhere outside the United States, your personal information will be transferred to, stored in, and processed in the United States. U.S. law may differ from the law of your country, and personal information stored in the United States may be accessible to U.S. courts, law enforcement, and national security authorities under U.S. law. By using the Site or contacting us, you understand that your information will be processed in the United States.

We use contractual protections with our providers designed to give your information a comparable level of protection wherever it is processed.

13. How we protect information

We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of the information we hold. These include encryption of data in transit (HTTPS across the Site), access controls limiting who can view CRM records, and the use of established providers with their own security programs.

No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you send information to us at your own risk.

14. Links to other sites

The Site links to third-party sites, including our LinkedIn page and our booking system. We are not responsible for the privacy practices of sites we do not operate. Review their privacy policies before providing personal information.

15. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. If we make material changes to how we handle personal information, we will provide more prominent notice — such as a notice on the Site or an email to you — before the change takes effect. Your continued use of the Site after an update means you accept the revised policy.
